Motorcycle wrecks

Situation

You are driving your motorcycle as your main mode of transportation or simply taking a nice Autumn ride on a Saturday morning; as you pass other motorcyclists you give The left hand waive. Either way, you are a motorcyclist who knows that it is not yourself you have to worry about, but the others around you. You know the others drivers around you will be the ones who can ruin your commute to work or your afternoon ride. You may be a rider on your crotch-rocket with your crash pants, carbon fiber gloves, and new helmet on, or you may be riding your Harley with your leathers, vest, and half-helmets on; either way, you are the one who is following the laws of the road.

Out of nowhere, a car decides to change lanes and carelessly hits you. You are not like the other drivers on the road; you are without the protection of a metal frame surrounding your body. The protection you do have is what you are wearing: it helps to save your palms, skin, and some head injury; however, you are still seriously injured. You are in worse condition then a driver who was hit while driving their automobile.

After the accident, you most likely will be suffering from injuries immediately; motorcycle accidents typically have immediate pain and not pain that arises a few days later. Either way, you are not in the same condition you were in before the accident. Now you are in pain and suffering from an accident that was not your fault; you know the medical bills are going to be expensive. While you are suffering and trying to figure out the procedure to follow in getting your life back to normal, you receive phone calls from the insurance company of the person who hit you. They are quick to contact you and quick to offer you a solution. Unlike car accidents, car insurance companies are quick to blame you instead of taking responsibility for their insured.

They may offer you some of the same things they would to an individual that was injured in a car accident or they may say you are to blame and not offer you anything. Either way, it will be an uphill battle simply because you were on a motorcycle and not in an automobile. If they do offer you medical bills, rental vehicle, extra money for suffering, and a new motorcycle, everything is ok.

Real Life

Everything is NOT ok! After suffering injuries, you realize what real life is about: you cannot work and are losing wages, you have to go through months of medical services to get your body feeling good again, you are in constant pain from doing daily activities, you cannot fully function with your children, you have to miss more work to go to medical appointments, you cannot focus on schoolwork… Now the offer you accepted from the insurance company for your medical bills and suffering is not looking so hot; the little extra money given to you on top of your medical expenses does not get close to covering the extra pain and suffering you have to go through.

Everything is NOT ok!  More likely than not, your motorcycle was totaled; the insurance company is only going to pay you the market value of the motorcycle before the accident. If the motorcycle was customized and had aftermarket parts, as do most, you better hope your insurance company covers the motorcycle because the other person’s insurance company will not cover the full additional cost of the custom and aftermarket parts. When it comes to property damage from an accident, Texas is not favorable to the injured for long term consequences to your motorcycle. You will not be put back in the same position you were before the accident. This is a reality that is unfavorable, but a reality that cannot be changed.

Motorcycle accidents require quick action. After the collision happens, a quick and immediate investigation of the accident is crucial to determine who is at fault and to preserve any evidence that is needed for a lawsuit. Without this quick action, evidence could be lost that is beneficial to getting you the right settlement.

Do not be mistaken, you are not at fault simply because the other driver did not see you. You are a driver on the road and the laws of the road apply to you the same as they apply to the other driver. If they did not see you, their inattention is the cause of the accident. As we all know from our experiences on motorcycles, the other driver’s inattention is the thing to worry most about when it comes to riding.
